Terms and Conditions

1. Provision of contract documentation

1.1 Upon booking (either verbally communicated or received in writing) and the provision of a valid credit card, the guest will receive a booking confirmation via e-mail or fax.

2. Occupation/handover of the room

2.1 Rooms can be checked into from 2pm onwards.

2.2 Should check-in time be outside of the opening hours (Monday-Friday 7am-9pm, Saturdays, Sundays and public holidays 9am-11am), the keys can be placed inside a key safe at the building, providing we receive suitable advance notice.

3. Duration of contract/pricing

3.1 Types of booking

3.1.1 For reservations of up to 13 nights (short-term bookings), daily rates apply. Reservations of 14 nights or longer are long-term bookings, for which package prices apply.

3.1.2 Long-term bookings may be for a limited or unlimited period of time (but no longer than six months). For limited long-term bookings, it is clear from the outset when the booking period ends.

3.1.3 The terms of the booking can be found in the booking confirmation.

3.1.4 Changes to the contract must be provided in writing.

3.2 Accounting periods (for long-term bookings)

3.2.1 The accounting period is in accordance with the booked package – either 14 days or one month.

3.2.2 The accounting period begins with the start of the contract (e.g. check-in on 11 May, accounting period is from 11 May-11 June).

4. Extension of accommodation contract

4.1 Reservations and renewals are subject to availability.

4.2 Limited long-term bookings expire when the pre-agreed booking comes to an end. Extensions must be agreed upon in writing.

4.3 Indefinite long-term bookings are extended automatically by one month, provided that they are not cancelled within the accepted time period (see point 5.6 for information regarding termination).

4.4 An extension is subject to “ROOM FOR RENT”’s confirmed conditions.

5. Termination

5.1 ROOM FOR RENT may terminate the contract for accommodation for cause without notice, in accordance with legal provisions, if the tenant has considerable arrears or has repeatedly violated house rules.

5.2 Upon conclusion of a contract, the guest may cancel short-term bookings without charge up to two days (48 hours) prior to arrival for a stay of up to 13 nights. For cancellations made after this deadline, prior to the arrival date, 90% of the price for the duration of the stay will be charged.

5.3 Following the conclusion of contract for a stay of more than 13 nights (long-term bookings), cancellation free of charge is possible up to 14 nights prior to the arrival date. Should the reservation be cancelled between 7-14 days prior to the arrival date, 25% of the booked billing period is payable. For cancellations between the day of arrival and 7 days prior, 50% of the booked billing period is payable. With cancellations on the day of arrival (after the start of the billing period), 100% of the booked billing period is payable.

5.4 For stays during trade fairs and events (e.g. Oktoberfest), a free cancellation policy is available up until 14 days prior to the arrival date. For cancellations made after this deadline, 90% of the agreed booking price will be charged. The rate for stays during trade fairs/other events is provided in the booking confirmation.

5.5 Should the guest fail to comply with ROOM FOR RENT’s agreed services (particularly regarding number of overnight stays), without terminating the contract, 90% of the price for the duration of the stay is payable.

5.6 The guest may terminate his/her contract at any time, provided 14 days’ notice until the next billing period is given. The termination must be provided in writing. For terminations or a reduction in the length of stay be made with fewer than 14 days’ notice, at least 50% of the contract fee is payable.

5.7 It is not possible to terminate the contract in the current billing period.

5.8 ROOM FOR RENT reserves the right to cancel the reservation immediately, should no timely transfer of the deposit be booked and the credit card charge cannot be placed.

6. Payment of accommodation fee and services

6.1. Payment for accommodation and reserved services is to be made to “ROOM FOR RENT” in advance, at the latest on day of arrival, via credit card (rates +4% handling fee), cash or bank transfer to the following account:

Short-term bookings can be paid on the day of departure, if a credit card is deposited upon arrival.

6.2. During trade fairs/special events, amended payment terms may be valid. These can be found in the quote and/or the booking confirmation. We reserve the right to debit the guest’s credit account (provided when reserving the accommodation) for the booking up to 14 days prior to arrival.

6.3. Should a third party provide a declaration to bear costs for a guest, a credit card is required for a security deposit.

6.4. Credit card payments are only possible with the following credit cards: American Express, Visa and MasterCard. The guest expressly agrees that “ROOM FOR RENT” may debit your account with a 1 cent (EUR) sample withdrawal at any time and may debit the provided credit card with any arrears/costs due to damages, which have not been paid upon departure.

6.5 During trade fairs and special events (e.g. Oktoberfest), a surcharge is payable for long-term stays that commence fewer than 90 days prior to the fair: For this period, the rate is 50% lower than the daily rates for this period. For a long-term stay of over 90 days (prior to a trade fair), no surcharges for the trade fairs/Oktoberfest will be charged. Should the long-term stay be interrupted (due to vacation, for example), it shall be considered terminated. The subsequent booking is then treated as an independent long-term reservation, and the 90 day period commences from this date. Rates during trade fairs are then 50% lower than the daily rates for this period.

7. Deposit

7.1 To safeguard against damages caused by intentional acts or negligence by the guest and to secure all claims of the owner on behalf of the tenancy, a security deposit is required for stays of one month or longer.

With bookings placed more than 1.5 months prior to arrival, the deposit must be transferred to a specific deposit account (the exact amount and account details are provided in the booking confirmation) 30 days prior to arrival at the latest.

With bookings placed less than 1.5 months prior to arrival, the deposit must be transferred to a specific deposit account (the exact amount and account details are provided in the booking confirmation) max. 48 hours upon receipt of the booking confirmation.

The deposit can also be delivered in cash at reception.

Should we be unable to register the deposit within the afore-mentioned time frames, a proportion of the deposit will be booked, including fee (+4%) from the credit card provided in the booking – which will be put toward the first monthly payment. The request for payment of the deposit remains unchanged.

For business clients, a written costs declaration may be accepted as an alternative to the deposit (to be discussed with “ROOM FOR RENT”).

7.2 The security deposit will be returned within 5 business days following the end of the stay to an account specified by the guest, as long as no claim has been made.

8. Temporary use / use of premises

8.1 The guest leases the accommodation on a temporary basis.

8.2 Subletting or other transfer for use of the room to other third parties not stated in the contract may only be made with the written consent of “ROOM FOR RENT”.

8.3 The keeping of animals is only permitted after consultation with “ROOM FOR RENT”.

8.4 All rooms are non-smoking rooms. Should smoking take place in the room or anywhere inside the building, an increased cleaning fee of at least 250 € will be charged. Upon repeated violation of this condition, “ROOM FOR RENT” reserves the right to immediate termination of the contract without refund of payment.

8.5 Upon check-in, the guest receives a programmed entrance card for entrance to the building and to the guest’s room, which will be returned upon departure.

9. Maintenance of premises

9.1 If damages to the room occur during the course of the stay, the guest must report these immediately.

9.2 The guest shall treat the room and all facilities with care.

9.3 The guest is liable to “ROOM FOR RENT” for damages caused by violations of his/her duty of care and duty of disclosure, particularly when rooms are not ventilated, cleaned or heated sufficiently, nor protected against frost.

9.4 The inventory must not be removed.

10. Shared use of communal facilities

10.1 In the communal spaces in the basement, a washing machine and dryer is available for guest use for a fee. These machines are used at the guest’s own responsibility and risk.

10.2 These machines, provided by “ROOM FOR RENT”, are to be treated with care and consideration.

11. Internet

11.1. Guests can make free use of the onsite wireless internet. “ROOM FOR RENT” assumes no liability should the network be overloaded or in case an internet connection cannot be established.

11.2 The guest is responsible for ensuring that the Internet is used only to the extent legally permissible.

12. Entering of the premises by “ROOM FOR RENT”

12.1 The management and/or their representative may enter the premises at any time on important grounds.

12.2 Should a guest be absent for more than a week, the guest is required to inform “ROOM FOR RENT” in advance.

13. Return at the end of accommodation period

13.1 At the end of the accommodation period, the clean room is to be checked-out of no later than 11am. Should the room not be handed over in a satisfactory condition at this time, the corresponding daily rate will be charged in full.

13.2 The guest shall reimburse “ROOM FOR RENT” for any damages in the leased room, insofar as the guest is responsible for these damages.

13.3 The guest shall replace or reimburse “ROOM FOR RENT” for any damages caused to the inventory, insofar as the guest is responsible for these damages.

13.4 Upon check-out outside of the opening hours, the following is to be adhered to:

    • All windows to be closed
    • All electrical appliances (with the exception of the refrigerator) to be switched off
    • All room keys to be left on the dining room table
    • The door to be closed from the outside

14. Liability of the Hotel

14.1 The hotel is liable for the performance of its obligations arising from the contract. Claims of the customer for reimbursement of damages are precluded except for such which result from death, injury to body or health and the hotel is responsible for the breach of the obligation, other damage which is caused by an intentional or grossly negligent breach of obligation and damage which is caused from an intentional or negligent breach of obligations of the hotel which are typical for the contract. A breach of obligation of the hotel is deemed to be the equivalent to a breach of a statutory representative or vicarious agent. Should disruptions or defects in the performance of the hotel occur, the hotel shall act to remedy such upon knowledge thereof or upon objection by the customer made without undue delay. The customer shall be obliged to undertake actions reasonable for him to eliminate the disruption and to keep any possible damage to a minimum.

14.2. The hotel is liable to the customer for property brought into the hotel in accordance with the statutory provisions. Accordingly, the liability is limited to, one hundred times the room rate but, however, a maximum amount of € 2,000 and, in deviation, for cash, securities and valuables, a maximum amount up to € 400. Cash, securities and valuables up to a maximum value of € 400 may be stored in the hotel safe or room safe. The hotel recommends that guests make use of this possibility.

14.3. Insofar as a parking space is provided to the customer in the hotel garage or a hotel parking lot, this does not constitute a safekeeping agreement, even if a fee is exchanged. The hotel assumes no liability for loss of or damage to motor vehicles parked or manoeuvred on the hotel’s property and the contents thereof, except for cases of intent or gross negligence. For the preclusion of damage claims of the customer, the regulation of the above-mentioned No. 1, sentences 2 to 4 supra shall apply respectively.

15. Severability clause

15.1 Should any of the contractual provisions become invalid, the validity of the remaining provisions shall not be affected. Should any part of the Agreement be deemed invalid, a lawful alternative will come into force which economically and legally resembles the invalid Agreement as closely as possible.

16. Jurisdiction and applicable law

16.1 As place of jurisdiction Munich is considered as agreed upon, provided that the requirements of § 38 ZPO apply to both parties. In disputes with legal entities of foreign countries within the EU, EuGVVO Art. 22 Nr.1 also applies.

16.2 German law applies exclusively.
